Summary/Abstract: Unlike the criminal legislation of Serbia, which defines mercy killing as a form of privileged homicide (Article 117), the Criminal Code of Republic of Srpska does not recognize such an offense. Terminating a person’s life out of compassion due to their severe medical condition could potentially be classified as a mitigated form of murder under Article 124(2) of the Criminal Code of Republic of Srpska, which prescribes a prison sentence of one to eight years for homicide committed under particularly mitigating circumstances. However, regardless of this, there are increasingly vocal arguments that euthanasia should also be legalized in neighboring countries. This paper highlights the key counterarguments and comparative European experiences, demonstrating that such propos￾als still do not merit support.
