Summary/Abstract: This commentary is based on a final court judgment which illustrates the complexity of the interaction between enforcement and enforcement mechanisms and emphasizes the need for a systematic hermeneutic of procedural rules to ensure a balance between the interests of creditors and the protection of third parties. The comment analyzes the mechanism of validation of the attachment in a dispute between professional sports creditors, sports club debtor, and third party creditors (Volleyball Federation, other clubs) where the Court validated the enforcement attachment against several third parties. The Tribunal admitted the third parties' objection of delay and rejected the creditors' request for validation as out of time, holding that the one-month time limit under Article 790 of the Civil Code runs from the expiry of the 5 days provided for in Article 787 of the Civil Code after the establishment of the attachment is served. The author of the comment criticizes the General Court's solution, arguing that the validation procedure obviously concerns the enforcement attachment (the enforcement of which follows the obtaining of the enforceable title), not the attachment ordered at the stage of the trial on the merits; thus, the dies a quo for the one-month time limit should be related to the service of the enforcement attachment, not to the service of the attachment. Neglecting this distinction may lead to unfair creditor detriment and affect the effectiveness of enforcement, especially in the insolvency of sports clubs.
