POLISH INHERITANCE DOCUMENTS (ACTS FOR CERTIFICATION OF INHERITANCE AND DECISIONS FOR ESTABLISHING THE ACQUISITION OF INHERITANCE) IN PROCEEDINGS IN BULGARIA

Summary/Abstract: European Regulation No. 650/2012 on the succession of persons who died after 17 August 2015 introduced a uniform system in Europe concerning the law applicable to succession. A uniform mechanism was also introduced to determine the jurisdiction of a specific EU country when the habitual residence of the deceased was in a Member State of the Union. According to Art. 21 of Regulation 650 on succession, the law applicable to succession matters is the law of the habitual residence of the deceased at the time of death (the choice of the law of the country of origin under Art. 22 of the Regulation, made in a will or under another form of mortis causa, is also possible). According to Article 4 of the Regulation, the court of the European Union country in which the deceased had his habitual residence has jurisdiction (it is also possible, according to Article 5, to transfer jurisdiction to the chosen native law, as long as it is the law of a European Union country).
