Summary/Abstract: The rapid evolution of artificial intelligence raises numerous legal challenges, requiring legislative adaptation to properly regulate the use of this technology. In the field of intellectual property, there are difficulties in determining rights over AI-generated creations, such as those produced by ChatGPT. Questions regarding the legal liability of AI in cases of harm are essential for the development of an effective legal framework. Although most countries do not prioritize AI regulation, the European Union has introduced new rules aimed at protecting individuals affected by errors in AI systems. In this context, clear and adapted legislation is necessary – legislation that maintains a balance between innovation and the protection of fundamental rights, while ensuring legal accountability in the use of AI. This study aims to address and propose solutions concerning the legal liability of AI systems.
