Summary/Abstract: Expressed in the Constitution of the Republic of Poland and concretized in the in local government laws, the subjectivity and independence of local government has a systemic significance for determining its position in the state and in the law. Municipalities, counties and provinces are entities that perform public tasks, which are statutorily equipped with rights and obligations. They can be defined as independent, legally created corporations of local society, which have their own internal organization; equipped with the attribute of legal personality and subject to state supervision to a certain extent. It should be noted that each local government unit acts on its own behalf and on its own responsibility, but at the same time cooperates for the public good. Thus, these units equipped with the attribute of legal personality can establish foreign cooperation. It is worth considering the answer to the questions: Can all categories of tasks of local government units be the subject of cross‑border cooperation? Who is authorized to supervise a local government unit undertaking cross‑border cooperation? The article will in this connection, the subject of cross‑border cooperation and its supervision will be characterized.
