Summary/Abstract: The manner in which the powers of the state interfere and cooperate shapes the nature of the political regime and the dynamics of constitutional equilibrium. Through the Constitution of 1991, revised in 2003, Romania enshrined a semi-presidential regime, characterized by complex relations between Parliament and Government, in which the parliamentary oversight function constitutes an essential component of the checks and balances mechanism. The present study examines the role and effectiveness of parliamentary control within the Romanian constitutional system, with particular emphasis on motions – especially the simple motion and the motion of censure – as defining instruments of the Government’s political accountability before Parliament. The study explores, on the one hand, the constitutional foundations of the relationship between the two authorities and the dependence of the Government’s existence and legitimacy on the vote of confidence granted by Parliament, and, on the other hand, the tendencies toward imbalance generated by the extensive use of emergency ordinances and the recurrent recourse to the assumption of governmental responsibility. The analysis seeks to answer whether motions function solely as instruments for the expression of political opposition or whether they constitute genuine constitutional mechanisms through which Parliament asserts its role as the sole legislative authority and the supreme representative body of the people. Through a doctrinal and jurisprudential approach, the study highlights that the effectiveness of motions does not depend exclusively on their formal outcome, but also on their capacity to generate public debate, transparency, and governmental accountability. In conclusion, the Romanian constitutional balance is profoundly influenced by the manner in which these instruments are employed, and the consolidation of representative democracy requires the revitalization of the parliamentary oversight function as an expression of national sovereignty exercised through elected representatives.
