The criminal disclosure of information constituting a state secret or of foreign classified information under article 357 of the Criminal code – first part

Summary/Abstract: The present study analyzes the legal norms under art. 357, paragraph 1, paragraph 2 and paragraph 3 of the Criminal code, which regulate the criminal disclosure of information constituting a state secret or foreign classified information obtained under an international treaty to which the Republic of Bulgaria is a party. All the signs of this crime have been critically examined.The main goal of the study is to contribute to the correct interpretation and lawful application of the norms under 357, paragraph 1, paragraph 2 and paragraph 3. A comparative analysis of this crime with the crime of „espionage“ under art. 104 of the Criminal Code has been carried out.
