Summary/Abstract: The normal development of criminal procedural legal relations inproceedings for early release under chapter thirty-five, section one of the Criminalprocedure code, is conditioned by the status of the convicted person to whom thisinstitute will be applied. This consideration is determined, on the one hand, by thestrictly specific immediate goal of this type of special proceeding, namely the reviewof the criminal status of the convicted, and on the other hand, by the participantswho carry out the relevant procedural activity in this proceeding. The differentiatedapproach in determining the competent court that can consider the specific proposals or requests for early release is distinguished in view of the status of the convictedperson and his possible participation in the special public relations due to militaryservice.
