RULE OF LAW VALUES IN THE CONTEXT OF ARTIFICIAL INTELLIGENCE

Summary/Abstract: The traditional values underpinning the rule of law must be re-evaluated in light of the contemporary dynamics generated by globalization and the rapid development of artificial intelligence. Artificial intelligence, globalization, and the ideology of transhumanism constitute defining phenomena of the current era, promoting a novel conception of the human being and of social existence – one that may significantly influence the fundamental rights and freedoms guaranteed by constitutional and legal frameworks. This study aims to examine the conceptual and ideological foundations of artificial intelligence, as well as the mechanisms through which human existence and social status risk becoming subordinated to technological imperatives. Particular attention will be devoted to the risks, challenges, and vulnerabilities that these emerging realities entail for the individual and for society as a whole. Furthermore, the analysis will address the international and national legal instruments governing the use of artificial intelligence, with a view to assessing their capacity to safeguard human rights and to preserve the essential values of the rule of law.
