Summary/Abstract: Przeszukanie aplikacji bankowych znajdujących się w telefonie komórkowym przez pryzmat prawa bankowegoSearching is one of the most intrusive procedural activities in the context of human rights and freedoms, which, as a rule, serves to reveal and secure objects that can constitute evidence in a case. The development of technology has led to the need for legislative changes, including systematization of searching devices and information systems that contain computer data. The introduction two decades ago of a provision that is lex specialis to the classic search operations systematized in Article 219 of the Code of Criminal Procedure testified to the fact that legal tools are being adapted to criminal methods used today. The paper analyzes search operations done on banking applications installed on processsecured cell phones through the prism of the Banking Law. It highlights research problems related to the lack of correlation between provisions on the appointment of experts and on search operations of information systems that contain computer data and the lack of statutory limitation of search operations carried out under Article 236a of the Code of Criminal Procedure. The study employs the method of interpretation of the law in force to thoroughly address the problem. The work closes with de lege ferenda comments on the provisions of the Banking Law and the Code of Criminal Procedure.
