3. Aspects regarding the scope of certain provisions established by Law no. 85/2014 regarding the prevention of insolvency and the insolvency proceedings

Summary/Abstract: The adoption of the new regulatory framework in the matter of insolvency, established by the Law no. 85/2014 regarding the prevention of insolvency and the insolvency proceedings, brings certain amendments with respect to the scope of this regulation, of the competence of the bodies authorized to enforce the insolvency procedure and the procedure of the enforcement of the final judgements which disposed the liability of the management bodies of the debtor, these amendments being required by the correlation of this regulation with the provisions of the new Civil Code, of the new Code of civil procedure and of the Tax Procedure Code. In this context, this study aims at an examination of certain provisions established by Law no. 85/2014 in relation to the scope of the new regulatory framework and of the competence of the insolvency judge. Likewise, certain aspects are examined in the content of the study regarding the procedure of the enforcement of judgements which disposed the liability of the bodies, which contributed to the condition of insolvency of the debtor, established by Law no. 85/2014, in conjunction with the provisions of the new Code of Civil Procedure and of the Tax Procedure Code.
