APPROACHES ON THE ENFORCEMENT PROCEEDINGS OF COURT ORDERS IN THE MATTER OF LAND USE AND URBAN PLANNING. OTHER WRITS OF EXECUTION IN THE MATTER OF LAND

Summary/Abstract: The category of administrative litigations falling within the scope of contentious-administrative courts also encompass disputes arising out of administrative deeds enacted / issued in the matter of land use and urban planning. Within the said framework, dealing with administrative litigations settled by courts specialized in contentious-administrative matters and, in default of explicit legal provisions stipulated by special regulations in the matter of land use and urban planning, enforcement of final and irrevocable court orders rendered on land use and urban planning matters follow the enforcement proceedings settled by the Administrative Litigation Law no. 554/2004. Though, on the subject of enforcement of court orders passed in this complex matter, enforcement of these judgments lies within the competence of public authorities, as shall be pointed out within the study hereby, not only if they have entered the pleas unsuccessfully, but also if eradication of illegal constructions has been ruled by virtue of final and irrevocable court orders. Under these approaches, the present study aims at analyzing the enforcement proceedings of final and irrevocable judgments’ execution and other writs of execution in the matter of land use and urban planning.
