13. The court competent to solve the complaint against the order to collect an illegally parked car. Legal nature of the challenged act

Summary/Abstract: Collecting an illegally parked car is nothing else but an activity to enforce a complementary penalty that must be ordered only by means of an offence report stating the given offence. The absence of this report does not change the offence nature of the penalty, but it is merely an impediment to ascertaining the liability for offence of the given person, an impediment to be acknowledged by the court fully competent in the matter of offences, namely the court of first instance.
