16. Branch of a legal entity – active subject of a contravention. Nullity of the minutes for insufficient description of the offense

Summary/Abstract: Active subject of offenses provided by G.E.O. no. 56/2007, republished, can be including a branch opened in Romania by an authorized foreign legal entity employing labor legally, the term „employer” including also the branch, as a subject of law without legal personality. Given that in the minutes of the offense are not listed the names of people who would have performed the work, the court made it impossible to verify the status quo stated by the official examiner, the minutes being null and void under art. 17 of G.O. no. 2/2001.
