Summary/Abstract: With the emancipation of labour law from civil law, an autonomous approach to classical legal institutions, including time limits, has become increasingly necessary, particularly when these do not concern the exercise of a right of action but rather the temporal limitation of a private disciplinary prerogative. The study examines the five time limits laid down by the Labour Code in regulating disciplinary proceedings, with particular emphasis on the 30 day and six month limits, which raise difficulties of legal classification. The analysis explains the reasons why both doctrine and case law have oscillated between classifying these limits as prescription or forfeiture, highlighting the differences in their effects and practical implications. The study therefore proposes a systematic and nuanced reading of the legal nature of these time limits, adapted to the distinct purpose of disciplinary liability in labour law.
