Summary/Abstract: The mayor is an authority of the local public administration in Romania, being both a representative of the state and of the administrative-territorial unit in which he was elected. The procedure for ascertaining the de jure termination of the mayor's mandate is expressly provided for in art. 160 of the Administrative Code, along with the cases that can lead to the termination of this mandate, among which we can mention, for example, the change of domicile in another administrative-territorial unit. Although the legal provision regarding the subject covered in the paper is brief, this aspect should not lead to the premature and erroneous conclusion that the procedure would be less important and would constitute a mere formality. The general secretary of the administrative-territorial unit, as well as the prefect, have important roles in determining the termination of the mayor's mandate, aspects that will be developed within the paper, and de lege ferenda proposals will also be presented in order to improve the currently existing legal framework.
