Procedural aspects related to the offence of domestic violence. The role of the prior complaint

Summary/Abstract: This article aims to analyze the procedural aspects related to the crime of domestic violence and, mainly, the role of the prior complaint from the perspective of the relationship between the availability of criminal action and its officiality. It will consider the legislation prior to the pronouncement of the Decision of the High Court of Cassation and Justice no. 30/2024 regarding the pronouncement of a question of law in this matter, the practice subsequent to this moment, as well as the legislative amendments brought by Law no. 116/2025, but also the effects generated in practice from the perspective of the more favorable criminal law.
