Summary/Abstract: Improper court composition is one of the absolute grounds for appeal in criminal proceedings. The occurrence of this circumstance leads to the judgment being set aside. It is assumed that every absolute ground for appeal constitutes an irrebuttable legal presumption that such a judgment is defective and cannot function in legal proceedings. Pursuant to Article 442 § 2 of the Criminal Procedure Code, the court a quo may, in the re-opening of first-instance proceedings, limit itself to disclosing evidence that did not affect the setting aside of the judgment. However, doubts arise as to whether improper court composition constitutes a circumstance referred to in the aforementioned provision. Therefore, this study analyzes the extent to which a court in the re-opening of first- -instance proceedings may rely on procedural actions previously performed by the court on the merits. The considerations are conducted in the context of the Supreme Court’s resolution of 23 January 2020.
