Summary/Abstract: The article is a literature review of plans, decisions and activities of the Presidents of the Second Polish Republic in 1939 – Ignacy Mościcki and Władysław Raczkiewicz. It also embraces the role of political figures, who had the chance to take over the Presidency, i.e. Marshal of Poland Edward Śmigły-Rydz and Bolesław Wieniawa-Długoszowski. This paper is a part of research on origins, course and follow-up of the Polish Campaign 1939. It puts additional accents on constitutional aspects of the political situation that so far had not been properly and thoroughly examined. This refers mainly to legal elements making the President of the Republic a key figure for the State to lead the fight and conduct the war.
