Summary/Abstract: This publication presents the phenomenon of shaping “new” personal rights in the context of human rights doctrine. The article starts with a presentation of the concept and regulation of personal rights in Polish law, followed by a discussion of the relationship between human rights and the protection of personal rights, as well as four contemporary trends in shaping “new” personal rights – these include, in particular, increasingly intensive protection of individuality, shaping “new” personal rights protecting relationships, and “new” personal rights resulting from the development of science, technology and the market economy – it should also be considered whether these are merely new ways of violating personal rights already recognised in doctrine and jurisprudence. The discussion concludes with a review of the contemporary phenomenon of attempts to treat interests protected by public law, as well as the interests of individuals related to the satisfaction of civilisational needs, as “new” personal rights.
