Summary/Abstract: The report examines judicial review over the decree of the prosecutor, by which he refuses to return the material evidence to the entitled persons (art. 111, para. 3 of the Penal Procedure Code (PPC) and the acceleration of the pre-trial proceedings (Art. 368 and Art. 369 of the PPC). It is argued this is sui generis judicial review.
