Summary/Abstract: The article (part two) analyzes the content of the concepts of “actual proprietor of a non-registered trademark” and “actual use in trade” of non-registered trademarks, examines the question of how the “earlier” nature of non-registered trademarks is determined and how the goods and services falling within their scope of protection are determined, and clarifies the significance of changes in the legal status of non-registered trademarks.
