Summary/Abstract: The report compares the employment contract and the competition as independent grounds for the emergence of the individual employment relationship. The similarities and differences in their factual compositions, relating to the duration, subjects, declarations of will, procedures for their implementation, emergence and beginning of execution of the respective legal relationships, are examined.
