A Qualitative Research on the Justifications of Administrative Fines Imposed on Independent Auditors and Audit Firms

Summary/Abstract: The study aims to examine the grounds for administrative fines imposed on independent auditors and audit firms and to examine the types of violations that occur in independent audit processes and that require administrative fines and the distribution of these violations according to the types of sanctions. The study data consists of 29 court decisions obtained from the UYAP system. These decisions were analyzed by content analysis method and the justifications of the penalties were classified and evaluated under three different sanction types (Warning, Suspension of Activity Permit, Revocation of Activity Permit). According to the research results, 5 of the 8 warning penalties issued were related to non-compliance with audit standards, 2 were related to non-compliance with professional ethical principles, and 1 was related to non-compliance with legislation. Of the total 14 penalties imposed for suspension of operating licenses, 6 were due to non-compliance with auditing standards, 3 were due to comprehensive deficiencies and errors, 3 were due to financial statement errors, and 2 were due to non-compliance with the principles of independence and impartiality. Of the 7 penalties related to the revocation of operating licenses, 4 were due to non-compliance with auditing standards, 2 were due to failure to apply basic auditing procedures, and 1 was due to non-compliant practices. The study fills an important gap in the literature by focusing on the grounds for administrative fines imposed on independent auditors and makes a unique contribution to the literature with its analysis based on court decisions.
