Summary/Abstract: The rapid development of ICT (Information and Communication Technology) in recent years has brought to the fore not only new concepts, such as artificial intelligence, but also a reality to which society is beginning to adapt and, especially, to regulate it, therefore responding to the challenges and the unknowns specific to any beginnings. Digitisation, as a first stage, followed by digitalisation and digital transformation could not ignore the cultural heritage – written documentary heritage (libraries); movable heritage (museums, collections); audio-visual heritage (audio-visual archives); immovable heritage (monuments, archaeology) – taking on the most diverse challenges, especially related to the legislative aspects that must be considered in this undertaking, of which compliance with copyright has been and still is a weakness. At this moment, artificial intelligence is also a field, increasingly embraced by the younger generation, suggestively named the digital born generation. All these technological transformations and innovative aspects mirrored in behaviours necessitated legislative regulation, with rules and limits on their usage, meant to ensure social and human balance. Specific legislation has regulated, disciplined and encouraged the effort of digitising the national cultural heritage, taking it out of the empirical area and professionalising it. This paper proposes to debate the most important European and national legislative landmarks of digitisation in Romania, norms which by their importance and especially their impact have built the base on which artificial intelligence is nowadays developing. We chose the year 2008 as reference point, as in Romania, only from that moment we can discuss about institutionalisation of the digitisation process, even if the efforts of the collectives from libraries and other cultural institutions to bring information closer and present it digitally, are previous to that year. Digitisation must not be confounded with artificial intelligence. Without debating the area of artificial intelligence, which is currently elaborating specific legislation worldwide and nationally, we intend to offer for the segment of digitisation and digitalisation of the national cultural heritage of Romania, the legislative landmarks that standardised and supported the development of this field.
