State fees in the warrant proceedings and related claim proceedings

Summary/Abstract: This study examines the mechanisms for determining the amount of state fees in order-for-payment proceedings and related claim proceedings,which is of significance for their uniform application by the courts in respect of all parties involved. The importance of state fees as a source of revenue for the Judiciary Authorities (JA) budget, as part of the state budget, is emphasized, while preventing their improper collection. The contradictions in court practice regarding the correct determination of the amount of state fees in ongoing claim proceedings are summarized, and conclusions are drawn as to the need for a a new interpretative decision on issues of warrant proceedings.
