The application of Article 59 of the Criminal Code in criminal cases and its place in the agreement for the termination of criminal proceedings

Summary/Abstract: The article analyzes the legal system of deducting from the specifiedpenalty of imprisonment, probation or deprivation of rights the time during which theconvicted person is a subject to restrictions of personal freedom and rights.The possibilities of application of article 59 of the Criminal Code, both in the criminalcases under the general procedure and in the agreement for the termination of the criminal proceedings, the existence of contradictory judicial practice and suggestions have beenmade to overcome it.
