Summary/Abstract: The year 2024 marked a pivotal moment in Romania's national political landscape, highlighted by a large-scale electoral process that took place at local, county, parliamentary, and presidential levels. The electoral atmosphere was intense and polarizing, giving rise to numerous situations involving both electoral contraventions and offenses, as well as administrative actions subject to judicial scrutiny through filings in civil and administrative courts. Significant litigation included annulment requests against resolutions, decisions, and actions issued by local and central electoral offices, as well as objections to the validation of local elected officials’ mandates. In this complex context, the present material aims to analyze the conditions for eligibility and the notion of electoral fraud, referencing the responsibilities of administrative bodies established specifically for the electoral process, as well as the role of the courts, particularly in regard to validating the mandates of elected officials under recent legislative changes. By examining the Administrative Code, current doctrine, and jurisprudence, this article seeks to clarify the principles and practices intended to ensure a coherent and uniform interpretation of the legislation, with the aim of providing stability to the electoral process and guaranteeing respect for democratic values.
