Summary/Abstract: This article addresses the complex and ambiguous nature of labour exploitation from a labour law perspective. Following an examination of definitions and interpretations within supranational, European, and Italian legal frameworks, the focus shifts to the systemic dimension of exploitation, with special attention to emerging forms related to work mediated by digital platforms. The article explores the objective indicators used to identify exploitation, alongside the subjective element of “taking advantage” of a state of need. Subsequently, it analyzes the scope and limits of criminal protection under Article 603-bis of the Italian Criminal Code. Finally, the central role of labour law in preventing and combating exploitation is discussed, highlighting the need for legal tools that effectively respond to the ongoing transformations of the contemporary labour market.
