Summary/Abstract: In Agamben’s interpretation, the Franz Kafka’s novels The Trial and The Castle are viewed in the light of Roman traditions in the field of penal law and the establishment of territorial frontiers. The abbreviation K. must be associated, according to the author, with the Latin term calumnia as well as with the term cardo related to the city planning. Because of its paradoxical nature, the calumny one makes against himself predetermines the trial that it causes. Also, the issue of the territorial frontiers and their social importance in Ancient Rome justifies the analogy with the concept of the frontier in the Kafka’s world and the hypothesis of what would its demolition provoke.
