Summary/Abstract: This study analyzes the most important theoretical and practical problems related to the emergence of employment relationships for temporary work as a type of atypical employment. The current legislation does not clearly regulate the legal relationships through which temporary work is carried out and which establish the rights and obligations of the parties, as well as the legal facts that establish them. This gives rise to disputes in the labor law doctrine and makes law enforcement difficult. Only when the legislation has a clear vision of the structure and mechanism of emergence of this type of employment relationship will the legal framework guarantee sufficient stability and security in the relationship between the participants in them and, even at the initial stage of their emergence, the rights and legitimate interests of workers and employees hired through temporary employment agencies will be sufficiently protected.
