PROTECTION OF ARTIFICIAL INTELLIGENCE OUTPUTS

Summary/Abstract: This article addresses the legal protection of artificial intelligence (AI) outputs.It analyzes the characteristics of AI-generated works, distinguishing between AI-assistedcreations and autonomous outputs. The current legal status of these results is examinedin the context of existing copyright systems, highlighting fundamental challenges relatedto the absence of human authorship. The article discusses functioning protection models,including the concept of „computer-generated works”, as well as alternative mechanisms inthe form of contractual protection and database protection regimes. The analysis indicatesthe inadequacy of current legal frameworks in addressing the challenges posed by advancedAI systems, arguing for the need to develop new legislative solutions that respond to thespecificity of AI-assisted and AI-generated creativity.
