Summary/Abstract: As new technologies have occupied an ever increasing space in everyday life, bringing advantages in terms of ease and speed of communication, the workplace has been faced with new challenges. The fact that employees can be easily contacted through digital means of communication has led in some cases to employers contacting employees even outside of daily work hours, during transit or even during vacations. Faced with this problem, legislators at the national and European level have come up with certain solutions in recent years, materialized in normative acts that aim to ensure the balance between professional and private life, as well as to strengthen the rules regarding the observance of working time. A number of six member states of the European Union have already addressed the „right to disconnection” in their legislation, and at the level of European Union law, the existing incident Directives are waiting to be supplemented with a normative act that would enshrine the right to disconnection definitively. Looking in a comparative perspective of the existing normative acts as well as the proposals from the EU level is a good exercise in order to regulate these aspects in the Romanian legal system.
