Summary/Abstract: Although, for the purpose of structuring the subject matter, the issue of spouses’ assets and that of their debts is treated separately—both by the legislator and by legal doctrine—judicial practice demonstrates a close interweaving of the regulations concerning them. This is because spouses assume obligations by participating in the circulation of material values, through the acquisition and disposal of assets, either to secure the necessities of life or to properly manage the property they own.
