Should minors be fully emancipated on grounds of becoming a parent?

Summary/Abstract: Is the birth and care of a child a justifiable reason for the emancipation of minor parents under Article 40 of the Romanian Civil Code? Should the desire to receive state allowances or child rearing benefits be a valid reason for granting emancipation to minor mothers? The Romanian courts have approved such requests. Nonetheless, the necessity of emancipating minor parents in all instances is a point of contention. We shall analyse childbirth, the exercise of parental authority, and the need to personally receive financial aid as serious reasons for emancipation and assess the soundness of the arguments that justify the necessity of judicial emancipation in these cases.
