Summary/Abstract: The paper aims to analyze the damage caused by losing a chance, which consists of losing a person's ability to make a profit or avoid a loss, a possibility which the creditor is deprived of by the non-execution of the obligation by the debtor. As reparation for the loss of a chance has given rise to controversy in both legal and judicial practice, the purpose of this article is to identify the conditions under which this type of damage may arise and the rules on compensation. In this paper, we will see that the reality and seriousness of the chance have an essential contribution in terms of confirming the certainty of obtaining the advantage
