Summary/Abstract: This paper proposes to briefly study the conditions of engagement of the civil delictual liability relating to the specificities of the medial field, in general, and of psychiatry, in particular. Also, this analysis features novel case-law, which helps us understand the different positive of negative obligations in the medical field.
