Summary/Abstract: With the new and major environmental challenges, represented by biodiversity erosion, climate change and widespread pollution, the appropriate legal response requires, more than ever, its adaptation through innovation and creative development of environmental law. The traditional positive arsenal anchored in strong anthropocentric traditions and fundamentally dependent on the dominant model of economic development appears, through principles and concepts, incapable of providing the means and tools necessary to protect and preserve natural and ecoclimatic balances, requiring in this sense transformations of substance, perception and expression.
