Summary/Abstract: The conditions for exercising a civil action are the basis for its admissibility. The Civil Procedure Code regulates the conditions generally applicable to all actions, regardless of their legal nature, but additional grounds can and are regulated in the special rules applicable to certain procedural steps. One of the particular situations can be found in the field of administrative litigation, in the current regulation of Law no. 554/2004. If the analysis of the general conditions for exercising an action has received special and constant attention in the specialized literature, the research of special situations in administrative litigation has rather been left to the task of jurisprudence. The present study aims to carry out a fundamental and, obviously, summary research of the particularities of the conditions for exercising an action in administrative litigation, paying special attention to procedural legitimacy and preliminary procedure.
