Summary/Abstract: This study examines the judicial practice of the Bucharest Court of Appeal and Bucharest Tribunal concerning the registration procedure of decisions by statutory bodies of political parties regarding the election of leadership members, focusing on the contentious or non-contentious nature of challenges to such decisions. Based on an analysis of relevant court rulings, the Law no. 14/2003, and the Civil Procedure Code, the paper identifies three distinct interpretive approaches: the registration as a mere administrative formality, a non-contentious judicial procedure, or a contentious procedure, depending on the case specifics. The study highlights the courts’ consistent application of legal provisions, balanced against the autonomy of political parties and the need for internal democratic accountability. Comparative insights from Germany, Poland, France and Spain are provided to contextualize Romania’s legal framework. Proposals for legislative reform are suggested to streamline administrative processes and enhance judicial efficiency in handling such disputes.
