Summary/Abstract: In recent years, there has been a consistent lack of interest from authorities in the sports sector in Romania. We believe this disinterest is a significant factor contributing to the existence of substantial legal gaps that can significantly impact athletes' lives. A notable instance in recent times is a widely publicized doping case in tennis, where an initial 4 year suspension was reduced to 9 months following an appeal, with the final decision being made after over 1 year and 4 months of provisional suspension. The repercussions of this scandal on the athlete’s life are undeniable, potentially even career defining for the individual involved. This paper aims to underscore the crucial role of the legal framework in sports activities. Athletes rely heavily on the technical staff surrounding them to enhance and sustain their athletic performance. Unfortunately, experiences shared by various athletes reveal instances where they do not receive fair, ethical, or legal treatment from their technical support teams. As a result, athletes often bear the brunt of the consequences alone. Therefore, we emphasize the significance of the contractual agreements athletes enter into, ensuring they provide assurances of acting in good faith and are legally binding, thus ensuring that the consequences of actions are distributed fairly among all stakeholders in the sports process.
