Summary/Abstract: Freedom of press and the protection of the journalist's independence represent a constant and consistent element in the policy of democratic states and international organizations in recent decades. Despite this fact, a new category of litigation has gained momentum in recent years, namely strategic lawsuits directed against public participation (Slapp), precisely against journalists, for their activity. Paradoxically, the worrying increase in the number of such litigations was not accompanied legislation updates, which led to an inconsistent practice at European Union level. At the moment there are three acts adopted by the European institutions, without binding legal force, namely a recommendation, a resolution and a proposal for a directive, however, their content predictably allows us to outline the conditions for placing a legal action in the Slapp category.
