Confiscation of a motor vehicle in the light of the applicable provisions of the penal code

Summary/Abstract: Issues concerning the forfeiture of a motor vehicle under the current regulations which came into force in March 2024 are addressed. Legal aspects are presented, focusing on the cases of mandatory forfeiture of a vehicle and the legal bases for the use of this measure are indicated. As in the Polish system these regulations are both revolutionary and controversial, doubts that arise already at the stage of proceeding them are discussed. It is also indicated that in view of the allegations described in the article and the persisting doubts mainly related to mandatory "car confiscation", legislative work is currently underway to modify them, aiming at substituting mandatory forfeiture of a vehicle in certain situations by optional imposition of this measure.
