Criminal liability of corporate officers for collective decisions: Preliminary findings

Summary/Abstract: The article addresses the fundamental issues concerning criminal liability of gov-erning members of collective entities for collective decisions within the scope of eco-nomic criminal law. It also presents police and court statistics relating to final convictionsfor crimes under Article 296 of the Polish Penal Code. A broader analysis covers decisionof Wrocław appellate courts in cases of crimes involving the issue of “criminal resolutions”under Article 296. The paper reports the findings of preliminary and pilot studies conductedas part of the research project titled “Criminal liability of members of collective entitybodies for collegial decisions in economic criminal law” carried out at the University ofWrocław in the second edition of the “Excellence Initiative—Research University” pro-gramme (abbreviated IDUB in Polish), funded through IDUB for the years 2020–2026.
