Summary/Abstract: As cyber-related aspects are increasingly become part of criminal activity, electronic evidence and the possibility of wide access to it are gaining more importance. The storage of this evidence outside the investigating jurisdiction prompted law enforcement authorities to actively explore avenues for collaboration with private service providers on a voluntary basis. This has resulted in the establishment of an informal channel of cooperation, running parallel to those established through mutual legal assistance and the principle of mutual recognition. The EU legislation has recently formalised this type of cooperation by adopting Regulation (EU) 2023/1543 on the European Extradition Order and the European Preservation Order for electronic evidence in criminal proceedings together with Directive (EU) 2023/1544. In this paper, the author explains the key provisions of this Regulation, and then critically reflects the guarantees for the protection of fundamental rights with regard to the privatisation of law enforcement procedures.
