Summary/Abstract: The paper deals with the issue of knowledge of the accused's criminal history when deciding on his guilt for another criminal act. This knowledge can negatively affect the subjective beliefs of the persons deciding on the guilt of the accused, which creates obstacles in relation to the consistent fulfillment of the principle of the presumption of innocence. The author tries to find a suitable solution to this de lege ferenda problem, taking inspiration from the Anglo-American legal system.
