SPECIAL REGIME OF INCORPORATION AND OPERATION OF PRIVATE HEALTH INSTITUTIONS IN THE FEDERATION OF BOSNIA AND HERZEGOVINA

Summary/Abstract: Private health institutions are becoming an increasingly significant segment of the healthcare system in modern societies. Given that this is a socially extremely important and strictly regulated activity, the process of establishing private health institutions is more complex compared to the general regime of establishing legal entities. This primarily involves the prior examination of meeting the conditions for conducting activities, both in terms of equipment and professional staff, making the process before the establishment of a private health institution extremely complex and demanding. Another significant aspect is the operation and supervision of the functioning of private health institutions after establishment, considering that these institutions engage in healthcare activities that are of broader public interest. In this paper, the authors investigate and review the legislation and practices related to the procedure of establishing private health institutions in accordance with the positive legal regulations in the Federation of Bosnia and Herzegovina, as well as the obligations of founders both during the establishment process and while conducting activities after registration. The main goal of the paper is to highlight the specificities of the legal status of institutions involved in healthcare compared to the general regime of establishing and operating companies in the law of Bosnia and Herzegovina.
