Summary/Abstract: The article analyzes the expression "act committed in public" as either a constitutive element or an aggravating circumstantial element of certain offenses, from the perspective of the online environment and cyberspace. Starting with a historical perspective and based on a jurisprudential analysis, it examines the range of applicability of legally provided cases in the online environment and offers potential solutions for particular scenarios that have emerged or may emerge in judicial practice. The conclusions indicate that current legislation does not impede the aggravation of criminal liability, where the law so provides, in cases of offenses committed through live streaming on the internet.
