The bluff or the pseudo additional protection of child against sexual abuse, from Law no. 217/2023

Summary/Abstract: This study aims to analyze the main errors contained in Law no. 217/2023 and demonstrate that, although the legislator claimed that the new provisions contained in this law will lead to increased protection of minors against sexual abuse, in reality, the changes that occurred, not only did not lead to additional protection but, have caused a decrease in this protection, both in a specific way, related to certain factual situations, and in a general way, through chaotic criminalization, which is difficult (sometimes impossible) to apply.
