On the need of a coherent approach concerning the precautionary measures ordered during the criminal trial. 18 proposals for the amendment of the Criminal Procedure Code

Summary/Abstract: The article analyses the main problems raised by the legal texts on precautionary measures established during criminal proceedings in order to propose, where necessary, the necessary legislative amendments. The proposals for amendments are based on the scope of these measures and the effects they have on the assets of the persons to whom they relate. Therefore, the paper analyses the need for modifications concerning the general conditions for taking precautionary measures, challenging precautionary measures, periodic review of measures and requests for their lifting. Particular attention is paid to the need to regulate a procedure for adapting precautionary measures, which currently poses many problems in judicial practice.
